{"id":8818,"date":"2023-11-20T08:10:00","date_gmt":"2023-11-20T07:10:00","guid":{"rendered":"https:\/\/www.smolio.ch\/wissen\/splitting-pillar-3a-assets-is-that-possible\/"},"modified":"2024-09-17T08:36:42","modified_gmt":"2024-09-17T06:36:42","slug":"splitting-pillar-3a-assets-is-that-possible","status":"publish","type":"post","link":"https:\/\/www.smolio.ch\/en\/wissen\/splitting-pillar-3a-assets-is-that-possible\/","title":{"rendered":"Splitting pillar 3a assets: is that possible?"},"content":{"rendered":"<span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Lesedauer<\/span> <span class=\"rt-time\"> 4<\/span> <span class=\"rt-label rt-postfix\">Minuten<\/span><\/span>\n<p data-block-type=\"core\">Help!\nI want to split my pillar 3a assets, the account has become too large.\nI don&#8217;t want to pay so much tax later on.\nIs there any way I can still split my pillar 3a?\nWe hear these questions all the time.\nDiscover three hacks to reduce the size of your 3a account.     <\/p>\n\n<!--more-->\n\n<div class=\"wp-block-stackable-heading stk-block-heading stk-block-heading--v2 stk-block stk-6c1344f\" id=\"grundsatz-ein-bestehendes-3-a-vorsorgeguthaben-kann-nicht-geteilt-werden\" data-block-id=\"6c1344f\"><h2 class=\"stk-block-heading__text\">Principle: Existing 3a pension assets cannot be divided<\/h2><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d3de0f0\" data-block-id=\"d3de0f0\"><p class=\"stk-block-text__text\">It is neither possible nor permissible to subsequently divide the credit balance on a 3a account into several accounts.\nOnce a credit balance has been posted to it, it is there.\nWhen making a regular withdrawal in old age, you can only withdraw an account as a whole, undivided.\nIf there is a lot of money in the account, this is not ideal in terms of <a href=\"https:\/\/www.smolio.ch\/en\/wissen\/tax-progression\/\">tax progression<\/a>.   <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2ad7101\" data-block-id=\"2ad7101\"><p class=\"stk-block-text__text\">What you can do at any time: transfer a 3a credit balance from one provider to another.\nThis is called a transfer.\nFor example, you can switch from a 3a savings account to a 3a securities solution or switch from a 3a fund to a digital 3a provider.    <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-9c128da\" data-block-id=\"9c128da\"><p class=\"stk-block-text__text\">However, it is not possible to transfer partial amounts from one account to another.\nNeither with the same provider nor with another provider.\nBut what can you do if you want to split your pillar 3a assets so that you can break the tax progression later and withdraw your accounts in stages?  <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e7e32ea\" data-block-id=\"e7e32ea\"><p class=\"stk-block-text__text\">We&#8217;ll show you three workarounds.  <\/p><\/div>\n\n<div class=\"wp-block-stackable-heading stk-block-heading stk-block-heading--v2 stk-block stk-4b0f12d\" id=\"hack-1-saule-3-a-verkleinern-durch-vorbezug-fur-wohneigentumsforderung\" data-block-id=\"4b0f12d\"><h2 class=\"stk-block-heading__text\">Hack 1: Reduce pillar 3a through early withdrawal for home ownership promotion<\/h2><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-195ff46\" data-block-id=\"195ff46\"><p class=\"stk-block-text__text\">If you wish to use your pillar 3a assets to purchase or build residential property, they may only be used for the purchase, renovation or refurbishment of owner-occupied residential property.\nIf you make an advance withdrawal of pillar 3a funds for home ownership, you can only withdraw part of your assets; there is no minimum withdrawal amount.\nWhat many people don&#8217;t know is that you can also withdraw money from pillar 3a for renovations or refurbishments, for example, and thus reduce an account that is too large.    <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-58e9f30\" data-block-id=\"58e9f30\"><p class=\"stk-block-text__text\">You can find more details and the differences between the WEF advance withdrawal in pillar 3a and the WEF advance withdrawal from the occupational pension plan in this <a href=\"https:\/\/www.smolio.ch\/en\/wissen\/advance-withdrawal-for-home-ownership-wef-home-ownership-promotion\/\">article<\/a>.<\/p><\/div>\n\n<div class=\"wp-block-stackable-heading stk-block-heading stk-block-heading--v2 stk-block stk-a1c7af4\" id=\"hack-2-saule-3-a-guthaben-aufteilen-durch-ubertrag-in-die-pensionskasse\" data-block-id=\"a1c7af4\"><h2 class=\"stk-block-heading__text\">Hack 2: Split pillar 3a assets by transferring them to the pension fund<\/h2><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-94d5ae8\" data-block-id=\"94d5ae8\"><p class=\"stk-block-text__text\">The transfer from pillar 3a to the pension fund is possible if you have a purchase gap in the pension fund.\nIn this <a href=\"https:\/\/www.smolio.ch\/wissen\/uebertrag-saeule-3a-pensionskasse\/\">article<\/a>, we describe how you can transfer pillar 3a assets to the pension fund.\nYou can then use your capital to convert it into a lifelong pension and increase your death and disability benefits.    <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-4e66b79\" data-block-id=\"4e66b79\"><p class=\"stk-block-text__text\">Splitting your 3a account works if your 3a balance is greater than the possible purchase amount.\nThis is because the remaining amount remains in your 3a account.\nHowever, your purchase potential in the pension fund should generally be greater than your 3a assets.\nAs a result, this option of subsequently splitting a pillar 3a credit balance is probably only available to a small number of people.     <\/p><\/div>\n\n<div class=\"wp-block-stackable-heading stk-block-heading stk-block-heading--v2 stk-block stk-fc9cc2c\" id=\"hack-3-saule-3-a-guthaben-splitten-bei-scheidung\" data-block-id=\"fc9cc2c\"><h2 class=\"stk-block-heading__text\">Hack 3: Splitting pillar 3a assets in the event of divorce<\/h2><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ae2bdea\" data-block-id=\"ae2bdea\"><p class=\"stk-block-text__text\">Sad but true: the frequency of divorce has increased in recent years.\nAccording to the <a href=\"https:\/\/www.bfs.admin.ch\/bfs\/de\/home\/statistiken\/bevoelkerung\/heiraten-eingetragene-partnerschaften-scheidungen\/scheidungshaeufigkeit.html\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Statistical Office<\/a>, two out of five married couples will divorce in the future if current divorce behavior does not change. <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-f0b8b45\" data-block-id=\"f0b8b45\"><p class=\"stk-block-text__text\">In the event of a divorce (or dissolution of a registered partnership), the pension entitlements accumulated during the marriage are generally <a href=\"https:\/\/www.smolio.ch\/en\/?p=5412\">divided equally<\/a> if you have not agreed on the separation of property.\nPillar 3a assets saved during the marriage are in principle part of the property settlement in the event of divorce.\nThis means that the 50\/50 division also applies to pillar 3a assets saved during the marriage.\nThe actual credit balance is always divided &#8211; i.e. the actual (net) credit balance minus the future tax burden.   <sup data-fn=\"97fa99f1-55dd-48df-89dd-bc790c87eb0e\" class=\"fn\"><a href=\"#97fa99f1-55dd-48df-89dd-bc790c87eb0e\" id=\"97fa99f1-55dd-48df-89dd-bc790c87eb0e-link\">1<\/a><\/sup>  <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e7beb31\" data-block-id=\"e7beb31\"><p class=\"stk-block-text__text\">In several rulings, the Federal Supreme Court has confirmed that Pillar 3a entitlements are not covered by the pension equalization of pension fund assets, but that the proposed share is a monetary claim and not an entitlement to specific assets.\nYou can therefore transfer either free assets or tied assets.   <\/p><\/div>\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3647f34\" data-block-id=\"3647f34\"><p class=\"stk-block-text__text\">So if you are liable to pay your ex-partner in the event of a divorce or dissolution of the registered partnership, you can then divide your overly large pillar 3a account.\nPlease note that the exact division of the capital in the pillar 3a account must be set out in a divorce agreement.\nIn addition, your 3a provider can only carry out the division if there is a legally binding divorce decree &#8211;
